  1. The Complainant on approach of Imran Kooshor an agent of the O.Ps opted for a deposit scheme on 01.12.2016 vide account No.12766900729 and was issued with pass book No.9750. The complainant deposited Rs.30,000/when the complainant learnt that the Opp.Parties are  defaulting money payment, asked the agent and O.P.No.2 for payment of the deposited amount. On 12.11.2021 when the complainant approached O.Ps for payment of maturity value the O.Ps failed to pay maturity value. The complainant not filed any documents showing rate of interest nor the maturity value except the term 60 months from the day of account opening i.e. 06.12.2016.
  2. The Opp.Parties did not turn up and hence set exparte.
  3. The Opp.Parties failed to repay the amount to the complainant on demand. Being harassed by the Opp.Parties this complaint has been filed for non payment of the deposited amount within 60 months by the Opp.Parties and it amounts to deficiency in service by the Opp.Parties.

                   Accordingly it is ordered.

ORDER

The complaint is allowed ex-parte against the Opp.Parties. The O.Ps are directed to pay the deposited Amount of Rs.30,000/- and assured amount within one month of this order along with interest @ 12% P.A. w.e.f.12 11 2021. For harassment and deficiency in service the O.Ps are liable to pay Rs.50.000/- compensation and litigation expenses of Rs.5,000/- . In case of non-payment within one month of this order, the entire amount will cover 14% interest P.A till realisation.

Order pronounced in the open Court today on 1st day of May, 2023.
