Heard Ms. N.Mitra, learned counsel appearing for the petitioner and Mr.U.J.Saikia appearing on behalf of respondent Nos.1 and 2.

                   We have gone through the explanation given in the condonation petition. A serious effort has been made by the petitioner to explain the  delay in para 5,6 and 7 of the application. We have also  gone through the  affidavit filed by the respondent nos 1 and 2 opposing the prayers for  condonation of delay. Through the prayer for condonation of delay is  seriously objected by  the learned counsel appearing for the respondent nos 1 and 2, considering the  importance of the  issues involved in the appeal, we have decided to condone the delay subject to payment of Rs.1000/- to the  respondent. Accordingly, the delay of 70 days is hereby condoned.

               Misc case stands disposed.

Registry shall allot a  number to the pending appeal and same shall be listed on 10/09/2012 for admission.
