Perused the complaint petition and documents filed by the complainant. O.Ps are absent and failed to file version in spite of service of proper notice. O.P. No.2 to 4 has been deleted by the petition of complainant on dt.08.08.2022. The case is lingering since 2016. On perusal of the complaint the O.Ps are involve in M.O. Janmabhoomi Building and Estate Infra Ltd. They issued shares of the Company to the different persons and the complainant is one of the share holder of the company invested Rs.2,00,000/- for purchase of share as per business term and condition to gain profit from the business. Since the complainant is a preferential share holder and the transaction made for gain of proportional profit as such it is a commercial

transaction and the complainant is not a consumer but a share holder. This Commission lacks jurisdiction to decide the matter as the complainant is not a consumer and the dispute relating to civil dispute. The Civil Court is the  competent authority to decide the matter. Hence the case is dismissed. Advised the complainant to take shelter of proper Civil Court .
