Now at this stage the complainant has filed a petition praying for withdrawal of the case with liberty to sue afresh on the plea of material defect appeared the complainant. 

Heard Ld advocate. 

Perused the petition. Considered. When there is material defect the forum is of the view that unless such defect be not cured it would cause prejudice to the complainant. 

Hence it is,

ORDERED

That the complainant is permitted to withdraw the case with liberty to sue afresh. Thus the case is disposed of.
