- The case of the Complainant is that the Complainant purchased one Samsung 6.5KG FRONT LOAD WW 66 R 20KG OS SLV Washing machine from O.P.No.1 fro Rs. 31,092/- with three year warranty and two years extended warranty granted by O.P.No.1. The O.P.No.2 is the service centre. In May, 2024 when Complainant encountered frequent electric shock registered a request on 18.05.2024 for maintenance vide service I.D. No. C000628090 but the O.P.No.1 not responded. On 02.06.2024 the Complainant contacted the authorised service centre and solved the problem paying Rs. 708/-.
On 27.10.2023 the Complainant also purchased one refrigerator from O.P.No.1 and availed extended warranty. The O.P.No.1 provided a coupon for 6 months from date of availing resQ Care Plan. On 17.04.2024 request for maintenance of refrigerator made but the O.P.No.1 cancelled the request without assigning any reason.
Being aggrieved complaint has been filed.
- The O.Ps after appearance failed to file the version within the statutory period.
- Perused the documents filed by the Complainant. The Complainant purchased the washing machine on 14.08.2020 and paid Rs. 4558/- to-wards extended warranty. The extended warranty for the washing machine is valid upto 14.10.2025. On 18.05.2024 service request service request made vide service ID C000628090 Sl. No. 04 JV 5PBN 700653. The Complainant filed M.R. No. 3601 dated 02.06.2024 of Sai Siddhi Agency, Authorised Service Centre paying Rs. 708/-.
The Complainant filed tax summary of refrigerator dated 27.10.2023. The extended warranty under My resQ plan serial No. 3273499 is upto 21.10.2027. The Complainant’s service request was cancelled on 19.04.2024. The request was made vide I.D. No. 8064978579 dated 17.04.2024.
- The O.P.No.1 has received premium for Rs. 4558/- towards extended warranty to repair the washing machine but failed to do. As an authorised service provider the O.P.No.2 also not provided any service which amounts to deficiency in service on the part of the O.Ps. For non service the Complainant was compelled to pay Rs. 708/- to Sai Siddhi Agency.
Secondly the Complainant purchased the refrigerator from O.P.No.1. The warranty continues till 21.10.2024. After service request on 17.04.2024 the O.Ps cancelled the service request which amounts to deficiency in service as no any reason has been assigned.
In both the cases deficiency in services of the O.Ps are established.
Accordingly, following order is passed:
ORDER
The complaint is allowed against the O.Ps. The O.Ps are jointly and severally liable to refund Rs. 708/- to the Complainant within one month of this order. In case of non-payment the amount will carry 12% interest P.A. w.e.f. date of filing till realisation. The O.Ps are directed to repair the refrigerator of the Complainant within one month of this order. For harassment and deficiency in service the O.Ps are to pay compensation of Rs. 50,000/- and litigation expenses of Rs. 20,000/- to the Complainant. In case of non-compliance the entire amount will carry 12% interest P.A. from date of filing till realisation.
