J U D G M E N T

            This is complainant’s case alleging deficiency of service on the part of the O.Ps.

            We have perused the complaint petition filed by the complainant and version filed by the O.P. No.2. The O.P. No.1 has not filed any version. From the version filed we ascertain that this matter was referred to the Arbitrator and the arbitrator has already passed an award. It has been held by the Hon’ble M.P. State Commission in the case of Shyamlal Patel Vrs. Manager, H.D.F.C. Ergo General Insurance Company Limited and others 2015 (4) C.L.T. 422 (M.P.) that once the matter is referred to the arbitrator and Award is passed by the arbitrator then the complaint before the District Forum under the Consumer Protection Act, 1986 is not maintainable. The complainant has not mentioned about the arbitration proceeding in his complaint petition and in spite of repeated adjournments he has not appeared before us to clarify matters.

            For the reasons stated above, this complaint case is dismissed leaving the parties to bear their own costs.
