01. This is a complaint filed under Section 17)1)(a)(i) r/w Section 3 of the Consumer Protection Act by the complainant to hand over the possession of the house on completion in all aspects as per agreed specifications in the agreement besides obtain of necessary occupancy certificate thereof, to pay back the additional amount received over and above the agreed sale consideration amounts to Rs.3,41,509/- collected at the time of registration, to pay the interest on home loan from the date of due date of hand over of house dt. 5.3.2010 to 28.02.2015 amounts to Rs.50,31,537/- and subsequent interest till the hand over of the house, to pay agreed amount of Rs.5/- per square feet per month from the due date of hand over dt. 5.3.2010to 5.09.2010 as per agreement and fair rental valve Rs.10/- per square feet per month super built up area from 06.09.2010 to till hand over of the possession of house, to pay compensation of Rs. 10,00,000/- towards cause of mental agony and sufferings there of and cots of Rs.50,000/-.
02. On behalf of the complainant and the opposite party it is represented that the matter has been settled out of Court. A Joint Memo to that effect is filed. Hence the complaint is dismissed as not pressed.
