  1.  This complaint is filed under section 12of the Consumer Protection Act alleging deficiency in service against the opposite party claiming certain reliefs.

The brief facts of the case are as under:

          The complainant is the scheme holder of Opposite Party No.1 and 2 registration letter S.No. BQ26B No.6222698 dated 31.8.2009 for Rs.30,000/.  As per the scheme the complainant had paid Rs.1,300/ per year from 31.8.2009 to 31.8.2015 and the total amount of scheme is Rs.30,000/ for that, the complainant entitled for 600sq yard of plot or Rs.30,000/. Thereafter several enquires about the plot with the  Opposite Party No.2 and 3 they failed to give proper answer.  The Opposite Party No.3 have collected the yearly premium from the complainant and at the time of last premium was paid the Opposite Party No.3 collected original registration letter also not submitted the last three payment receipts.  After several enquiry, there is no response from the opposite parties hence issued registered notice to the opposite parties.  The 1st Opposite Party falsely replied to the same was served to the 2nd Opposite Party and not paid the amount. Hence the complaint filed  by the complainant before this forum under section 12 of the C.P.Act 1986(here in after referred to as the Act) seeking direction to pay the Rs.30,000/ to the complainant with  12% interest from31.8.2015 till payment and to pay Rs.30,000/ as compensation along with Rs.20,000/ as expenses and certain other reliefs.

II. Version Notice served to the opposite parties by RPAD, inspite of receiving notice the Opposite Parties not present before the for a nor represented the case hence placed exparte.                 

III.     In support of the above complaint, the complainant M. RamannaNaika,filed affidavit evidence as CW1 and produced documents got marked at Ex.C1 to C14.  Since the Opposite Party placed exparte not lead evidence nor produced any documents before the fora.

IV.     In view of the above said facts, the points for arise for our consideration in the case are:

  1. Whether the Complainant proved that the Opposite Party committed deficiency in service?
  2. If so, whether the Complainant is entitled for any of the reliefs claimed?
  3. What order?

        We have considered the arguments submitted by the complainant and considered the materials, placed before the Fora and answered the points are as follows: 

                           Point No. (i) : Affirmative

                           Point No. (ii) : Affirmative

                           Point No. (iii): As per the final order.

REASONS

V.   POINTS No. (i) and (ii):As per Ex.C1 the complainant is entitled to receive the amount of Rs.30,000/ or the 600sq yard and the Ex.C2 to Ex.C10 shows that the complainant paid 1,300/ per year from 31.8.2009 to 31.8.2015.  but after several enquiry with Opposite Party No.2 and 3 , for allotting the plot or refund of the amount they failed to give any answer. Now points for consideration is that the documents produced by the complainant shows that the complainant paid amount of Rs.30,000/ and  the opposite parties are not contradicted the evidence of the complainant and placed exparte.  Therefore we are presumed that the complaint along with the documents produced by the complainant is true.  Further we also noted that the prayer of the complainant is  claimed relief from the Opposite Party No.1 and 2 only and not claiming relief from the Opposite Party No.3 and also not establish the case against Opposite Party No.3. In view of the above, the Opposite Party No.1 and 2 jointly and severally shall pay Rs.30,000/ along with 9% interest from 31.8.2015 till the date of payment and also pay Rs.10,000/ as compensation for mental harassment and Rs.5,000/ as litigation expenses is meets ends of justice. As such answer the point No.1 and 2 is affirmative.

In the result, accordingly we pass the following Order:

ORDER

The complaint is allowed.  Opposite Party No.1 and 2 are jointly and severally shall pay Rs.30,000/ along with 9% interest from 31.8.2015 till the date of payment and also pay Rs.10,000/ as compensation and also pay Rs.5,000/ as litigation expenses. Payment shall be made within 30 days from the date of this order.

Case against Opposite Party No.3 is hereby dismissed.        

Copy of this order as per statutory requirements, be forwarded to the parties free of cost and file shall be consigned to record room.
