Final Order / Judgement

                        Heard Mr. D. Baruah, learned counsel appearing on behalf of the petitioner and Ms. A. Goswami, learned counsel appearing for the respondent nos 1 to 4. A/D cards have been returned after due service upon respondent nos 5 &6, but none appears on behalf of the respondent nos 5 and 6 therefore, we have decided to proceed ex-parte against the respondent nos 5 and 6, in this Misc Application.

                        This is an application for condonation of delay of 54 days in filing the  connected appeal and an affidavit has been  filed by the clients represented by Ms. Goswami opposing the prayer for condonation of delay.

                       We have gone through  the  explanation  given in para 3 and 4 of the application  and we are satisfied  that the petitioner  was prevented  from  filing the appeal  within time though at the  same time we hold that the submission of the  learned counsel for the respondent nos 1 to 4 is not without  substance. The judicial trend as on today , is to take a liberal view in the matter of condonation of delay unless  the delay is deliberate or without any sum balance of acceptable explanation. Having considered all the facts and also explanation  given in the application for condonation, the delay of 54 days is hereby condoned.

                       The Misc case stands disposed.

                        Registry shall allot a number to the applicant and the same shall be listed on 10/05/2012 for its admission.
