1) Though   separate  complaints are filed against the very same  opposite parties by  different complainants,  we deem it fit that all these matter can be clubbed together for passing a common order  since the facts and law are common. 
2) These complaints are  filed u/s 17(a)(1) of the Consumer Protection Act  to refund the amounts paid by them  with interest @ 12% p.a.,  together with compensation and costs. 

3) The  case of the complainants in brief is that  Op1 is a  private limited company registered under  Companies Act engaged in  real estate business  wherein Op2  is  the Managing Director, Ops 3 to 5 are directors.  They floated a venture  wherein they agreed to sell land in an extent of 2,536 sq.yds @ Rs. 3,500/- per sq.yd with DTCP approval.  The complainants had paid various amounts on various dates covered under receipts.    Op1 agreed to develop  these sites with black top roads, under ground drainage, compound wall, club house,  avenue plantation, clear title,  and spot registration etc. by issuing brochure.   Later they found that  there was no development.   Thereupon they insisted  to refund the amounts paid by them on which  Op2  issued cheques  for Rs. 25 lakhs which were dishonoured  with an endorsement ‘insufficient funds’.  Basing on which a case u/s 138 and 142  of N.I. Act  was filed by them and the same is pending.   Since no amenities whatsoever  were provided  as per brochure  they did not go ahead  by paying the amounts.   Some of the plot owners formed into  an association under the name and style of  ‘Prakruthi Nivas Plot Owners  Association’ wherein they have become members.   Though Op2 assured them in writing  that he would arrange  physical possession  he did not do so.   No activity whatsoever  had taken place and the cheques for Rs. 25 lakhs said to have been paid to the association have been returned for insufficient funds.   It became clear that the Ops did not intend to get  the various amenities mentioned in the brochure to be provided.  Therefore they sought for refund of the amount together with compensation and costs. 
4) The opposite parties did not choose to contest the matter despite the fact that notices were served. 

5) The complainants in proof of their case filed their affidavit evidence and got Exs. A1 to A47 marked. 

6) The points that arise for consideration are :
I. Whether the complainants are entitled to refund of the amount?
II. Whether the complainants are entitled to interest? If so at what rate?
III. Whether the complainants are entitled to compensation?
IV. To what relief?

7) It is an undisputed fact that  Op1 is a private limited company  incorporated under  Companies Act vide Ex. A2  certificate of incorporation.    They published a brochure  Ex. A1 promising to provide black top roads, under ground drainage,  electricity, compound wall, club house,  avenue plantation,   clear title,  and spot registration etc.  The opposite parties  had agreed to provide 400 sq.yds of plot  @ Rs. 3,500/- per sq.yd in 24  instalments situated at Maheshwaram in Ranga Reddy Dist.   The complainants have paid various amounts evidenced under receipts. 

8) The complainants assert that when they insisted the Managing Director  to refund the amounts paid by them  he gave undertakings vide Exs. A6 to A8.    He gave  an undertaking to Dist.  Consumer Information Centre, Hyderabad under Ex. A9 to provide various facilities that were mentioned in the brochure.    However, he did not do so.    Therefore the complainants got issued legal notice  dt. 14.5.2010  to refund the amount  alleging that the cheques that were issued towards part payment of the amount were bounced.   From this un-controverted documentary evidence filed in this regard, we are of the opinion that when the developer  fails to develop the venture as promised in the brochure viz., black top roads, under ground drainage, electricity, compound wall, club house,  avenue plantation, clear title,  and spot registration etc. it  amounts  to deficiency in service.   In fact we have an occasion to consider  this aspect in   Badam Chandraiah Vs. Happy Home Constructions Pvt. Ltd. reported in II (2011) CPJ 256.    Since the   opposite parties did not fulfill the promises made in the brochure the complainants are entitled for refund of the amounts paid by them. 

9) In the result the complaints are allowed in part directing the opposite parties to refund the amounts as shown hereunder
