1. This is a revision preferred by opposite parties 1 and 2 against the order dt.14.12.2009 passed in CFR.No.1260/2009 in CC.No.21/2009 on the file of District Consumer Forum, Adilabad, obviously on a memo filed by the complainant. A perusal of the order does not disclose as to what exactly the memo was filed and the order passed thereon.
2. The revision petitioners contend that on the application filed in IA.36/2009, the complaint was closed in view of arbitration proceedings in the matter. They further contend that when a memo was filed, again the matter was reopened and passed the impugned order. At the outset, we may state that the District Forum shall go through the entire record and pass whatever order it intends to pass. However, we are unable to understand the exact order that was passed on the memo. It is not known, why memos are being entertained and elaborate orders are being passed which make the parties to think that the matter was again reopened which according to the revision petitioners was disposed of.
3. In the circumstances, the impugned order is set aside and the matter is remanded to the District Forum. The District Forum is directed to pass appropriate orders after perusing the entire record and shall not pass conflicting orders.
4. The revision petition is allowed with the above said observation.
