Both the parties present Complainant filed legal heir certificate of Rakikesh Agrawal. The Complainant is the sole legal heir. death certificates of Ajay Kumar Agrawal and Rakikesh Agrawal has been filed. Heard both the sides. As Sakuntala Devi Agrawal is the only surviving heir of policy holder Ajay Kumar Agrawal and nominee Rakikesh Agrawal, there is no legal impediment to settle the claim of the Complainant. Heard learned advocate for the O.P. who assured to settle the claim within one month.
Accordingly, this complaint is disposed of with the observation that the O.P. will settle the claim of complainant in policy No. 592858855 dated 12.08.2005 for 1,10,000/- along with permissible interest till date, failing which it will be treated that the O.P. is deficient in providing its service to the Complainant and the amount will carry 12% interest P.A. from the date of maturity till realisation along with compensation of Rs. 10,000/- and litigation expenses of Rs. 5000/-
Complaint case is disposed of.
