On perusal of order sheet it discloses that, since 07.02.2017 the matter is posted for to file affidavit evidence of complainant, but inspite of sufficient opportunity, complainant did not chose to file his affidavit evidence. It shows that, the complainant is not interested in prosecuting the case. The stand of law is very clear parties to proceedings shall prove their case by tendering oral or documentary evidence and merely on the basis of pleadings complainant cannot prove his case. Pleadings are not the substitute for evidence. Under the circumstances, the complaint is dismissed for want of prosecution. | |
