JUDGMENT

1. The case of the complainant is that, he has submitted his application form for admission into +3 course through online process and has paid Rs.275/- towards application cost. On scrutiny of his application form he was allowed to take admission in the college of O.P.1 as per his 5th choice of college. Accordingly he paid the admission fees of Rs.3700/- through online. After completing the process of admission by the time he went to the college of O.P.1 to addend the class he came to know that he was transferred to the college of O.P.2. To this the complainant went to the college of O.P.2 but found that, his name is not found in the attendance register. The complainant alleges that although he has completed all the formalities for admission through online process he was debarred from his study due to the negligent act of the O.Ps. Hence the complaint.
2. The O.Ps. have contested the case by filing their version separately. According to O.P.1 the complainant took admission into the +3 Arts 1st year class in his college on dated 20.7.19. But his choice of college was upgraded to the college of O.P.2 through auto slide up system of SAMS and hence his college has no role to play in the entire admission process. According to O.P.2 the complainant was selected for admission in his college in the second selection list on dated 7.9.19, but the complainant had not reported before the college for his admission on the said date his candidature for his selection was for-fitted as per the SAMS guideline. On receipt of instruction from Higher education Dept. the O.P.2 allowed the complainant for admission in the college.
3. O.P.3 send his version through speed post. According to O.P.3 he was the Director of Higher Secondary Education and was retired from service since 31.3.19. The O.P.3 submitted that, he is no way connected with the admission process of Degree College under SAMS. Perused the documents filed by the O.P.3 which shows that he was not an officer of the degree college and hence he is not a necessary party for the admission of the complainant into +3 courses.
4. Heard the complainant who appears in person. The complainant submitted that he is entitled to compensation for the loss of his study for about one month. Besides compensation the complainant has not raised any other point. Perused the complaint petition, written version and documentary evidence available on record. The O.P.1 has admitted that the complainant took admission in his college on dated 20.7.19. The O.P.1 has not produce any evidence to show that there was change of college for the admission of the complainant under auto Slide up system of SAMS. The O.P.2 has stated that the complainant was selected in the second selection list on dated 7.8.19. When the complainant took admission in the college of O.P.1 on dated 20.7.19 there is no reason for any second selection on dated 7.8.19. It is seen from the check list filed by the O.P.2 that he has acted as per the choice of one Mihir Babu. Therefore the admission process under SAMS has not binding on the O.ps. and they have acted without any sincerity. There is no reason for the O.P.1 to send the complainant to any other college after his admission under the prescribed online process.
5. The aforesaid act of the O.Ps. Cannot be said to be fair and are playing with the study of a student by blaming the SAMS system. It is not understood why there is a second selection after admission of the complainant and there is no reason to act as per the choice of one Mihir Babu. Due to this negligent act of the O.ps. the complainant has been sufficiently harassed and is entitled to compensation.
6. During course of argument the complainant has admitted that he has already been admitted in the college of O.P.2 and hence it is not necessary to issue any direction relating to admission of the complainant. Hence ordered:-
O R D E R
The O.P.No.1 and 2 are directed to pay Rs 20,000/- (Twenty thousands) to the complainant towards compensation and cost within one month from the date of receipt of this order.
Order pronounced in the open Forum to-day the 24th day of February 2020.
Accordingly the case is disposed off.
