The complainants made some investments with the O.ps on fixed deposits for six months with the assurance from the O.Ps that interest @11.50 % p.a would be paid on the deposited sums. The O.Ps issued seven separate fixed deposit certificates to the seven number of complainants. All the fixed deposits matured on different dates of March and June, 2014. After the maturity date was over the complainants prayed for payment of the sum invested together with interest but the O.Ps did not refund the amount admissible. Hence, the complainants have filed the present complaint case with prayers for such relief/reliefs as contained in the petition of complaint.
Despite service of notices upon the O.Ps, none appeared on their behalf with written versions. Hence, the case proceeded exparte against both the O.Ps.
In the course of the present proceedings the petitioners informed that the O.Ps have refunded the amount due together with interest accrued thereon to three out of seven complainants. So, only four depositors have not been paid their investments.
The complainant nos. 1,3,4 and 6 who have not been refunded any amount against their investments deposited following sums against fixed deposit receipt number Folio and date of maturity proceed as under :-

The complainants have annexed FD receipts in support of their claims for investments. The complainants filed common complaint petition which was supported by affidavit. Contentions of the complainants as contained in the complaint petition remains unchallenged . We do not find any reason to disbelieve the contention of the complainants.
The O.Ps have not dared to file any written version . So, we place reliance upon the allegations made by the complainants.
Upon hearing of arguments of the Ld. Counsel for the complainants and going through the documents placed with the record we find that the O.Ps have not refunded the amounts due upon maturity to the complainants. This indicates that there was a clear deficiency in services on the part of the O.Ps. Hence, the complainants are entitled to get the refund of the amount deposited by them with agreed interest thereon. The complainants are also entitled to get compensation for the mental agony and sufferings caused to them for the deficiency in services on the part of the O.Ps.
With the findings as above, we hold that the petition of complaint should be allowed and hence it is
Ordered
That the petition of complaint is allowed exparte in part against the O.Ps
The O.Ps are directed to pay jointly and/or severally the maturity amount to the complainants nos.1,3,4 and 6.
The O.Ps are also directed to pay jointly /severally Rs.5000/- to each of the complainant nos. 1,3,4 and 6 as compensation for their mental agony and harassment.
All the payments should be made by separate account payee bank draft within 30 days from the date of this order.
In the circumstances of the case there will be no order as to cost.
Let a copy of this order be served upon the parties free of cost.
