The complainant took no step and found absent on repeated calls. The O.P. Nos. 1 and 2 SBI file hazira along with bank statement.

It appears from the case record that the complainant was directed to file show-cause but he did not turn up to file application showing cause. It appears from the bank statement that SBI has already paid Rs. 80,000/- to the complainant which was unauthorizedly withdrawn from the ATM. As such when the complainant did not turn up to contest the case, there is no need to continue the case further.

Hence, it is

That the instant case be and the same is dismissed for non-prosecution..
