2.           The brief facts of the complaint are that the complainant had obtained           pre-closed the loan without resolving the dispute over processing charge and levying undue pre-closure charges, late payment penalties and also started charging interest at 36% PA instead of 15% PA.    

 

3.           The opposite parties 1 to 3 filed counter denying the allegations made in the complaint and mainly contended that the complaint is barred by limitation since the transaction was pre-closed on 25.03.2006 and the complainant did not raise any objection within

5. Having heard both sides and considering the material available on record, the District Forum allowed the complaint in part directing the opposite parties

Feeling aggrieved with the said order the dis-satisfied complainant filed this appeal on several grounds and mainly contended that the repayment of Rs.49,110/- were more than sufficient to liquidate the outstanding loan as on 30.09.2006 at greed rate of interest at 15% PA. The respondents have no authority or legal sanctity to exercise the lien over appellants’ accounts to the extent of Rs.8,377.03 ps on 29.09.2009 an Rs.33070.87 on 22.04.2010 after a gap of nearly three years from the date of final payment.

9.          As seen from the impugned order in view of the rival contentions of both parties a direction was given to the opposite parties to comply with the reliefs sought for by the complainant as per the terms and conditions of the credit card agreement and the banking rules and certainly it is a vague order. Crucial document is the credit card agreement because it guides all the concerned touching the points which are in dispute.   have lien over amounts of the complainant.
