Sri S.C. Sahoo, Member-This is a Complaint praying for a direction to O.Ps to take actual meter reading and issue electricity bill as per the meter reading along with 35,000/- towards compensation & cost of litigation.

       The brief facts of the case are that the Complainant is a consumer before the O.P-1 bearing consumer no.62120/380063 having 3 Phase electricity line with 2.50 KW connections connected on 5.6.2012 under Biju Krushak Vikash Yojana for irrigation of his agriculture land in which a Bore Well was dug up on 20.4.2012 and the Motor Pump was installed in October 2013 and after 2 months i.e. in the month of December 2013 the pump did not lift water and to this the complainant lodged a complaint to the Dist. Collector, Keonjhar, a new bore well was dug up on 15.4.2014 and motor pump was installed in the bore well. Hence this case as electricity bill supplied without consumption of electricity.

      After service of notice the Ops appeared and filed their written version respectively. Though O.P-1 stated in his written version that this complaint has no basis and the same are untenable and not maintainable in the eyes of law and further stated that power supply was provided by this O.P from 2.6.2012 for irrigation pumping and agricultural tariff and a new meter was installed in the bore well on 5.9.2013 with a meter reading of 66418 unit as on 5.9.2013 which reveals from meter installation report and the complainant has not paid any amount towards energy charges from the date of power supply till March 2015 for which an arrear amount of Rs.16,815.02p. is pending against the complainant. And the present case is barred by law of limitation and prayed for dismiss the case.

      The O.P No.(2&3) in their written version stated that the bore well was dug up in the field of the complainant on 8.7.2011. After electrification of the bore well motor pump was installed in the bore well during 1.5.2012 which was running successfully. But in the month of February 2013 the bore well was collapsed with motor pump and with other accessories were chocked inside the bore well which was within the warranty period and to this a new bore well was dug up near the previous bore well on March 2013 and the new motor pump was installed on December 2013 is running successfully thereafter and this O.P (2&3) are no way liable for this case.

       Heard the parties in this case and perused the materials available in the record. It is not disputed by the Opp. Parties that the complainant was a consumer before them. The only dispute arised by the complainant against the Opp. Party-1 since the bills are supplied to the complainant without consumption of electricity from 2.6.2012 instead of 15.2.2014.

       On perusal of electricity bill it reveals that the bills were supplied to the complainant from 14.8.2012 to till March 2015 on provisional basis imposing 262 units for a month wherein there is an arrear of 16,031/- was remained outstanding against the complainant. But the O.P (2&3) stated in their version after collapsed of bore well as well as motor pump in the month of February 2013 the new motor pump was working and installed in the bore well from December 2013 which needs to be considered for revision of electricity bill.  

ORDER

Hence, the O.P-1 is directed to provide correct/ revised bill to the complainant on actual basis from December 2013 to March 2015 for payment of electricity dues onwards deducting the period of collapsed of the bore well as well as the motor pump from February 2013 to December 2013 within 30 days of receipt of this order. No cost and compensation as to harassment & litigation.

               Accordingly the Case is disposed of.
