 JUDGMENT

Brief  fact of the complainant as alleged:- 

1 .           The complainant being attract all the scheme of advertisement  of OP no 2  deposited a sum of Rs. 2,00000/- on dated  13/05/2019 with Op No.1 for a period of eighteen  month and the said deposit would  be mature on 13/11/2020 with an amount of Rs,2,29,400/- and issue with a certificate vide C No. 925010673740ultimately the deposit was matured on  13/11/2020 and the complainant  had deposited the original certificate on 21/04/2021 with OP No.1 but no amount was credited to the account of the complainant the complainant made several attempt through letters to know the reason but in vain But all of a sudden on 22/11/2021 a sum of Rs 30, 000/- was credited to the account of the complainant   and

 Rs 2,00,00/- is still to be paid by the OP No.1.

              The OP  No.1 and 2 remain silent after several request. Hence the case .

To substantiate his case the complainant relied on the following  documents.

1.     Xerox  copy of the deposit certified vide No. 925010673740 dt.13/05/2019

2.     Xerox copy of letter dated 20/04/2021 and 06/09/202

2.            Having gone through the complainant its accompanied documents and on hearing the        complainant prima facie   it seemed to be a genuine case hence admitted and notice to the OPs were served but the OPS did not appear be for the court sufficient opportunity has been given to the OPs and accordingly both the OPs  set expert on dt. 10/11/2022.

              This commission feels and observe that the OPs are not interested to take part in this case hence order against the OPs  as expert.

                                                          ORDER   

               This commission pleased to direct the OP No.1 and 2 to pay a sum of Rs.2,25,000/- out of which 2,00,000/- towards the deposit amount Rs 20,000/- towards mental agony and Rs.5000/- towards litigation expenses  within one month from the date of order failing which the Ops is directed to pay the entire amount @ 12% P.A from the date of filing of the case till realization.

                            There is no order as to cost.

                      Accordingly the case is disposed off.
