Aggrieved by the order in CC 30 of 2011 on the file of District Forum, Adilabad, the complainant
For reasons aforementioned, opposite parties have failed to establish by means of any documentary evidence that the insured suppressed cardiac and renal problems prior to the issuance of the policy, therefore this appeal is allowed and the order of the District Forum is set aside and the complaint is allowed directing the opposite parties to pay the sum assured of Rs.2,40,000/- with interest at 9% p.a. from the date of repudiation till the date of realization together with costs of Rs.3,000/- to be paid within four weeks from the date of receipt of this order.
In the result, this appeal is allowed and the order of the District Forum is set aside and the complaint is allowed directing the opposite parties to pay the sum assured of Rs.2,40,000/- with interest at 9% p.a. from the date of repudiation till the date of realization together with costs of Rs.3,000/- to be paid within four weeks from the date of receipt of this order.
