Facts of the case in nutshell:-

                Complainant on dt. 28.03.2022 applied for issuance of certificate copies in urgent basis from the office of Tahasildar , Binika . For the said propose I affixed court fees of Eleven  Rupees in each application from and  I submitted the application from to the Tahasildar , Binika directly. Tahasildar

Sri Mukteswar  Panigrahi ( OAS) put his signature over the application forms to the Record keeper Sri Laxmi  Narayan Dani . Record keeper did not provide the certified copies within the stipulated period. For which sent the reminder letter through registered post on Dt.25.04.2022 and the Tahasildar Binka did not Replied.

                        During 28.03.2022 to 25.04.2022 have gone directly and approached to provide the copies  but they said they are searching  records  in this way  4 times gone during   one month . But till  today they have not intimated to complainant.   On dt. 17.05.2022 sent 2^nd reminder and Tahasildar has no reply.

                The 3^rd Reminder on dt. 16.06.2022 to Tahasildar Binika and no response from the part of  Tahasildar , Binka regarding copy of application form. As the  records are very essential  to  Complainant  and  Tahasildar has not issued the record to complainant and  he is losing  a very lot of landed property  when the Tahasildar has not provided the copies of the records, so lost most precious properties.

                OP No.1 and OP No.2 was  received the notice of the commission But they neither they appear before the commission nor they files their versionOP1 and OP2  do not show any interest in this case   and Not appear before the commission and files there version , so  I directed to proceed with a case experte,  because OPs on its or fails to take any action to represent his case within the given time version.  Due to their negligence , complainant not getting proper  Justice  and deficiency in service by OPs. Hence both the parties are set experte.

                                                                            ORDER

                In the view of above in detail I observed  that present complainant deserved  succeed. Hence  I directed to  OPs to compensation for the  great loss.

1.          To pay Rs Rs.50,000/- for  irrecoverable loss.

2.          To pay Rs.30,000/- for mental agony and physical harassment and Rs.1000/- for  litigation charges

3              This order be complied with OP within one month from the date    of receipt of this order. Failing which it shall make payment of amount mentioned above within  12 % interest per annum from of  filling  the present complainant till  realization.
