1.    `1,05,000/- with interest and a sum of`2,00,000/-towards damages to the respondent.

2.            `2,41,150 and the respondent applied for new pass book by returning the existing pass book. The assistant branch manager of the first appellant bank informed him that the new pass book can be collected within two days and on 22.11.2010 he informed the respondent that he could collect the pass book at the counter.

3.            `56,150.82.The respondent lodged complaint with the branch manager of the first appellant bank that he had not issued cheque to any one and how the amount of`1,85,000/- was cleared from his account.

“We are herewith submitting the true Extract of statement of account and also photographs from CC TV camera of our bank on that particular time and date ( i.e., on 18.11.2010) on which the amount is withdrawn by the third party culprit whilst on the subject. 

A)    Submission of pass book by the applicant might be known to their family members

B)    Signature of the account holder might be known to the family members other

“When the matter is under the investigation before a statutory authority, the complaint without knowing the final result of the investigation is a “pre-0mature”and that, the complaint is liable to be dismissed on the ground that the case is pre-mature as the matter is under investigation.    rd

15.              However, the rate of interest awarded by the District Forum is scaled down from 9% to 6% as there is no contract between the parties to pay interest @9% on the amount kept in savings bank account.
