This is an application under section 12 of the C.P Act filed by the complainant Sri Diti Kanta Lahiri Chaudhury alleging deficiency in service on the part of the O.Ps.
In short, the case of the complainant is that he , in search for a shop , came into contact with the developer O.P-5 series and entered into an Agreement for sale on 4.4.2007 among them for purchasing shop no.15 on the ground floor back side of the building at premises no.109, Sree Colony, P.S Jadavpur, Kolkata – 92 measuring 112 sq.ft super built up area at a total consideration of Rs. 2,00,000/- . Accordingly complainant paid full consideration money to the O.P-developer who also delivered physical possession of the said shop room to the complainant .
The complainant after the embargo period of 10 years from the date of mother deed dated 15.2.2000 is over requested the O.Ps for execution and registration of the sale deed but the O.Ps willfully and deliberately failed and neglected to render their services as per agreement . Several requests followed by letter dated 22.11.2014 did not yield any fruitful result and hence this case.
Decision with reasons
Today is fixed for S.R. Complainant filed a track report showing that S.R was served upon all the O.Ps and O.P-5(i), 5(ii), 5(iii) already appeared and filed written version supported by an affidavit and stated that they are ready and willing to execute and register the deed of conveyance in favour of the complainant in respect of his flat as confirming party to the said deed and they have also submitted that complainant already paid full consideration money and complainant is also in possession.
In this circumstances to expedite the matter when the complainant is ready and willing and O.P developer also likes to cooperate in this mater and land owner O.P nos. 1 to 4 remain silent inspite of service of summon, it is the duty of the Forum to see that the tears of the complainant should be meted out immediately.
Hence,
Ordered
That the application filed under section of the 12 of the C.P Act is allowed on contest against O.P-5 series and exparte against the rest.
The O.Ps are directed to execute and register the deed of conveyance in respect of the shop room mentioned in the schedule in favour of the complainant within 30 days from the date of this order, failing which, O.P nos. 1 to 4 are liable to pay compensation of Rs.25000/- and litigation cost of Rs.5000/- .
It may be mentioned here that after the stipulated date complainant is at liberty to get the deed of conveyance executed and registered through the machinery of this Forum and in that score O.P-5 series will stand as confirming party.
Complainant is at liberty to recover the amount of compensation and litigation even after completion of registration if he so desire from the O.P nos. 1 to 4 because due to their unfairness and deficiency in service the complainant is not getting deed of conveyance.
Let a plain copy of this order be served upon the parties free of cost.
