1.Softek Surya (India) Pvt.Ltd.Khasra No.1897  3/3, Gali NO.8, Main Firni Road village Kapashera near Falad Nala, Delhi – 110037 through its Manager.

2.Karbon Mobiles, D-170, Okhla Industrial Area, Phase-I, New Delhi 110020 through its Manager.

3.M/s Service Zone, SCO -22, Ist Floor, Karnal through its Manager/Authorized Signatory.                                                           ……… Opposite parties.

 

                    Complaint U/s  12  of the Consumer

                     Protection Act.

ORDER:

 

 

2.                 Sh.Mohit Tayal  Advocate for the Ops made  statement that Ops are ready to   replace the mobile set of the complainant with the same model  or same features  within a period of thirty days subject to the  condition that the complainant will return the old mobile set alongwith accessories, without any liquid damage or breakage to the Balaji Communications, the authorized service station of the Ops. It was also stated by him that the new shall carry warranty of six months. Thereafter,

 

 

 

 

the learned counsel for the complainant has made a statement for withdrawal of the complaint by submitting that having regard to the statement of the learned counsel for the Ops, he does not want to pursue the present complaint.

Statements of both the learned counsel for the parties have been recorded separately.

 

3.               In view of the statement made by the learned counsel for the complainant, the present complaint is dismissed as withdrawn. However, the parties shall be bound by their respective statements. The parties concerned be communicated of the order accordingly and the file be consigned to the record room after due compliance.
