                        This case filed by the above named petitioner, alleging deficiency in service/unfair trade practice on the part of the O.Ps named above, is taken up for amicable settlement between the parties in accordance with the provisions under section 21 of Legal Services Authority Act, 1987.

                        Both the parties are present personally. After a prolonged deliberation between the parties through active participation of the Members of the Bench, the parties have arrived at an amicable settlement. The settlement appears to be voluntary, valid and legal and as such the same is accepted and acted upon.

                        Hence,

Ordered

That the case is disposed of in terms of amicable settlement arrived at by the parties.

The O.P is directed to replace the old mobile set of the petitioner/complainant by a new brand mobile of Intex made , Model   no. Aqcua-S-3 within 15 days  of passing this order with one year warranty , failing which the O.P will have to pay a sum of Rs.10,000/- as compensation to the complainant . The complainant will return the old mobile set of him to the O.P at the time of replacement and he is not required to pay any money to the O.P for supply of the new mobile set .

Let a copy of this order be given to the parties concerned free of cost immediately.
