This complaint is filed under section 17 (1) (a) (i) of Consumer Protection Act, 1986 praying this Commission to direct the Opposite Parties:

a)   To replace the defective four wheeler vehicle of model AUDI A6 35 TDI BSIV bearing the Reg.No.TS07 EX 4500 with new one without any defects or alternatively refund the amount of Rs.47,56,000/- paid by the Complainant towards the cost of the above vehicle with interest @ 18% per annum from the date of payment till realization;

b)   To pay a sum of Rs.20.00 lakh to the Complainant towards compensation for the mental agony and anxiety suffered by him and his family members;

c)    To award costs.

Counsel for Complainant and for OP2 present.  No representation for OP1.  Joint Memo of Complainant and OP1 filed stating that the claim against the OP2 is not pressed and the subject matter covered under the C.C. is settled by and between the parties amicably subject to terms and conditions of Memorandum of Understanding dated 04.02.2017.  In view of the same the complaint is dismissed as withdrawn.
