The learned counsel for the petitioner, Mr.V.Appa Rao, submits that the entire amount paid by the petitioner/complainant herein towards sale consideration has been refunded by the Maytas Properties Limited i.e. the respondent(s) herein. He further submits that the decree passed in C.C.No.27/2011 is totally honoured and in those circumstances, nothing survives in this matter and requests that the E.A. may be closed. In those circumstances, we are of the view that the matter need not be kept pending as nothing survives in this E.A.
Accordingly this E.A. is closed and any other interlocutory applications pending in this E.A. also shall stand closed. There shall be no order as to costs.
