        This is a complaint   filed  by the complainant to direct the opp.parties to pay to the complainant  an amount of Rs.12,18,000/- with interest from the date of the complaint till payment,  Rs.10 lakhs towards compensation,  Rs.25,000/- towards costs. 

 

The complainant  booked a flat  in the venture of opp.parties and    after paying some amount towards the 1st  instalment,   on account of his personal reasons, he  requested the opp.parties  to cancel the booked flat    and refund the amount paid by him.    Though the complainant    submitted all the documents as demanded by the opp.parties,   they did not refund  the amount paid by him.   Hence the complainant issued legal notice to the opp.parties demanding  refund of the amount paid by him.  As the  opp.parties did not pay the amount paid by him, the complainant filed this complaint seeking above said directions to the opp.parties.    

     

       Today  counsel for the complainant  filed  a memo dt.30.3.2016  in which it is  stated  as   follows:

        “It is submitted that the complainant informed that the matter has been settled out of court and  requested to withdraw the same. Hence it is prayed that this  Hon’ble Commission may close the above complaint as settled out of  court. Hence this Memo.”

 

 Counsel for the complainant  served a  copy of the above  said memo to  counsel on other side.      Since the matter is settled by and between the parties, the complainant  is permitted to withdraw the complaint.

     In the result,  the complaint is dismissed as withdrawn.
