  1. The Brief fact of the Complainant is that the Complainant has purchased one Washing machine of the OP Company on dtd. 31.12.2016 with a Warranty period of one year. On 16.01.2017, the Complainant found that the machine has gone defective. The Complainant rushed to the dealer and intimated the facts. The dealer sent a mechanic and got repaired the same on dtd. 28.01.2017 but the machine was not repaired properly. The Complainant requested the said dealer to replace the defective washing machine as the same is within warranty period but the dealer did not listen. The Complainant again and again requested to the OP to replace the item but they did not heed the request of the Complainant. Hence the Complainant filed this case.
  2. The OP is set ex-parte.
  3. The O.P not repaired the washing machine properly nor replaced the washing machine. It amounts to deficiency in service on the part of the O.P.  

Accordingly, it is ordered:

                             ORDER

The O.P is directed to replace the defective washing machine from the Complainant and pay Rs. 50,000/- as compensation towards mental agony and harassment to the Complainant within 30 days from the date of order, failing which the amount will carry with 9% interest per annum till realization.

Order pronounced in the open Court today on 13th day of June, 2023.
