This Execution Application is filed praying to punish the respondent No.2/opp.party no.2 U/s. 27 of C.P.Act for non complying the order of this Commission in C.C.No.114/2012 dt. 23.8.2013.
Counsel on both sides present. Counsel for the Respondent no.2 filed a Memo dt.4.12.2015 stating that they have filed F.A.No.710/2013 before the Hon’ble National Commission and it was disposed on 20.7.2015 by way of compromise according to which respondent no.2 was directed to pay Rs.7,95,000/- to the complainant and after payment of the said amount permitted to withdraw the amount deposited by it before this Commission and as per the said direction of the Hon’ble National Commission the respondent no.2 has already paid Rs.7,95,000/- to the complainant by way of HDFC Bank Cheque bearing no.349475 dt.25.8.2015. It is further stated in the said Memo that the respondent no.2 will file proper Cheque Petition for withdrawal of Rs.3,53,494/- along with accrued interest in due course and as such the Execution Application has become infructuous and prayed to dismiss/close the E.A. Along with the above said Memo, the respondent no.2 filed copy of the order dt.20.7.2015 passed by the Hon’ble National Commission in F.A.No.710/2013 and memo of settlement and also copy of the Cheque for Rs.7,95,000/-.
Counsel for the petitioner/complainant confirmed the above said payment and informed this Commission that the matter is settled in terms of the order of the National Commission. In the circumstances, this E.A. is terminated.
