1) This revision is directed against the order dt. 15.10.2013 in CC No. 574/2013 before the Dist. Forum-II, Hyderabad. The docket order reads as under :
“Counsel for complainant is present. Notice on Opposite Parties 1 to 3 is served and Opposite Party Nos. 1 to 3 are called absent. Service held sufficient. Time extended for evidence affidavit of complainant and marking documents to 12.11.2013.”
From a perusal of the said order, though it does not show that the Opposite Parties are set ex-parte, it clearly prohibited the Opposite Parties from filing their written version. In those circumstances, we are of the view that the Opposite Parties have lost their valuable right of filing their written version. Of course, it is only on account of their laches, the Dist. Forum passed the said order. We are of the view that the Opposite Parties may be given an opportunity to file their written version. Accordingly, the said order is set-aside, and the Dist. Forum is hereby directed to afford opportunity to the Opposite Parties to file their written version.
2) Accordingly, the order impugned in this revision is set-aside, however, on payment of costs of Rs. 7,500/- (Rupees Seven Thousand and Five Hundred Only) to the Bar Association of this Commission. On production of receipt, as to payment of costs, as ordered, the Dist. Forum is hereby directed to proceed further, in accordance with law.
