- This appeal is filed by the complainant U/s 15 of the Consumer Protection Act, 1986 challenging the impugned order dated 17.04.2015 passed in CC No. 422 of 2013 by the District Consumer Forum III, Hyderabad in dismissing the complaint with costs of Rs.5,000/- to be paid to the opposite parties within 30 days.
- The facts in brief are that the complainant is having an Account with the opposite party No. 5 Bank and having two Credit card bearing Nos. 4477 4701 0575 5004 and 44774668 4017 8015. He has taken loan from the OP. 1 bank for his business as well as personal requirements and there were never any delays for repayment of the loan or for EMIs.. In the Month of April, 2010, the complainant has applied for a personal loan of Rs.6.00 lakhs to OP.5 bank with all necessary documents. As he did not receive any information from OP 5 bank till 19.05.2010, he complained to the Ops 1 and 2. The opposite party No. 1 office instructed the Loan Manager to sanction the loan to the complainant. The first opposite party No.1 has visited the office of the complainant and collected the required documents. But the loan was not sanctioned. He was not in a position to pay the amounts to the credit card transactions also. The OP No. 5 is harassing him for non payments of the credit cards dues by sending rowdies and threatening calls. Despite his letter dated 08.02.2011 to the OPs 1 and 2 to settle his loan under one time settlement, there was no response. OP 5 resorting to extract exorbitant interest on the credit cards from him which amounts to deficiency in service and hence the complaint to streamline the credit card, Rs.one lakh towards compensation, Rs.2 lakhs towards compensation for mental agony and costs.
- Counsel for the appellant present. Sri Harsha vardhan Deshmukh, Legal Manager of ICICI Bank, Hyderabad representing R1 to R5 present. Both sides represented that the matter is compromised by and between them. They also filed compromise Memo reiterating the same that they have amicably settled the matter for receiving Rs.1,60,000/- ( Rupees One Lakh Sixty Thousand ) only from the complainant despite outstanding dues of Rs.3,69,111/- on both the credit cards utilized by the appellant/complainant bearing card Nos. (1) 4477 4701 0575 5004 and (2) 4477 4668 4017 8007 and closed both the credit card on receipt of Rs.1,60,000/- and waived off the balance amount in accordance with terms and conditions accepted as mentioned therein.
- Memo is recorded. In view of the compromise Memo, the appeal is disposed of accordingly.
