Sri Purusottam Samantara- In brief, the complainant retaining A/C No- 220510142, corresponding to old A/C No- C 7C20, in availing electricity claimed be a consumer.

 

2. It is submitted the O.Ps without any notice disconnected the electricity line. It is also said the O.P did not respond to reconnection the line with repeated complaint lodge.

 

3. Further submitted the electricity disconnected without notice has caused harassment and mental agony, and above all illegal. Prayed the arbitrary action is deficiency of service along with unfair trade practice. So a direction be passed to connect the electricity line and pass other reliefs as deemed fit under C.P Act 1986.

 

4. On notice, the O.Ps neither appeared nor made any version on his defence and remains silence having giving with repeated opportunity to take defense.

 

5. Hence we prefer to decide the case on merit and basing on the relevant documents relied with and on record.

 

6. On perusal of record, it reveals, the complainant relied on a photocopy of a bill retained in favour of the complainant which is issued in june 2012. Which is barred of limitation.

 

7. Further observation, the bill is due amount of Rs 65552/- unpaid till the date, It is astonished that     the live connection of the electricity line is on record or otherwise. But no present bill has been produced by the petitioner as evidentiary value, it is settled principle, the photocopies are mere papers and have no evidentiary value in adjudication even the petitioned facts can’t be made reliable as no-competent affidavit has placed before this forum in proper time and repeated opportunity.

 

7. So entire gamut of story is suspicious and filed with ulterior motive. The petitioner has not come to this forum with clean hands. The case has no cause of action along with barred of limitation lacks merit. Thus thereby is dismissed.

 

8. The O.Ps are directed to deposit a sum Rs 1,000/- (one thousand only) in Consumer welfare Fund, Keonjhar for not heeding the call of the forum having giving with several opportunities consecutively within thirty days of this order, failing per day Rs5/- penalty will accrue till realization .

 

      Copy of the Order be made available to the parties as per rule.

     File be consigned to record room.
