Final Order / Judgement

ORDER

Per – Hon’ble Mr. V. P. Utpat, President

          None present for the Complainant even on second call.  Today Complainant failed to appear before this Forum without any sufficient reason.  Perusal of the order-sheet reveals that so was the position even on previous two dates viz. 30/12/2016 and 03/11/2016.  Complainant also failed to take appropriate steps for service of notice to the Opposite Party, in compliance with earlier order dated 30/09/2016 passed by this Forum.  Thus, in these peculiar circumstances, it does appear to this Forum that Complainant has lost his interest in further prosecution of present consumer complaint.  Hence, it is not desirable to prolong the case.  Consequently, consumer complaint stands dismissed for want of prosecution in accordance with provisions of Section-13(2)(c) of the Consumer Protection Act, 1986 read with Rule-4(7) of the Maharashtra Consumer Protection Rules, 2000.  Parties shall bear their own costs.
