The complaint was filed by the complainant U/S 12 of Consumer Protection Act 1986 alleging deficiency in service on the part of the opposite parties in selling defective vehicle along with direction to direct the opposite parties to replace the defective vehicle with a new one and pay a sum of Rs.5,00,000/- as compensation for mental agony caused to the complainant due to the negligent and deficiency in service on the part of the opposite parties and to pay a sum of Rs.10,000/- towards cost of this proceedings to the complainant.
The present case was adjourned on several dates i.e., on 01.04.2022, 12.04.2022, 28.04.2022, 16.05.2022, 26.05.2022, 16.06.2022, 17.06.2022, 13.07.2022 and on 25.07.2022. All these hearings the matter came up for filing proof affidavit of the complainant. But there was no representation by the complainant on all these days. Hence the matter was adjourned in the caption “for dismissal” on 13.07.2022 and 25.07.2022, still there was no representation for the complainant and no proof affidavit was filed. The matter was passed over twice today, still the complainant failed to appear inspite of information given by this Commission for appearance. Hence this Commission is of the view that there is no purpose in keeping the complaint on file. Hence the complaint is dismissed for default and we order no order as to cost.
This order was pronounced by us in the open Commission on this 25th July 2022.
