Order No.27.

Dt.09.05.16.        The contention of the petition filed by the complainant is that ld advocate on behalf of the complainant could not attend the Forum at the time 12.25 p.m. – 12.30. p.m.  as there was a huge traffic jam on the road and that ld advocate reached at 12.35 p.m.  Accordingly delaying caused in non-taking steps of the complainant.  Accordingly, Order of dismissal has been passed.  Hence, prayer to recall dated 04.09.2015 and pass appropriating order i.e., order giving an opportunity to the complainant.

Perused the record.

The order dated 04.09.2015 runs as follows.

“No step.  None came on second call at 12.25 p.m.

                                               O R D E R E D

It is 12=30 p.m.

The party is not interested to conduct case.  Same is therefore, stands dismissed”. 

Considered. 

There is no provision in the Consumer Protection Act, 1986 to modify any order passed by this Forum. 

Accordingly, the petition dated 04.09.2015 is considered and stands rejected. 

It is pertinent to note that this case has been instituted against two OPs.  Those OPs do not live within the jurisdiction of this Consumer Forum.  The complaint also shows that the OPs are within the state of Bihar and this Forum has no jurisdiction to try this case.

Accordingly, the petition is disposed of.
