            This is an application under section 12 of the C.P Act filed by the complainant on an allegation that he has applied for new connection on 6.7.2015 and quotation was received on 15.7.2015 through one employee of the WBSEDCL. Thereafter he enquired the matter and came to know that it was held up in the project office. But when the matter has not been solved ,he has filed this complaint with a prayer for supply of electric connection and compensation of Rs.10,000/- as well as cost.

            The O.P filed written version denying all the material allegations of the complainant. It is the positive case of the O.P that this case is not maintainable and no deficiency in service is adopted by the O.P and service connection is effected on 22.4.2016 vide meter no.HRI 80781 by the RE Project Office , O.P-2. Accordingly, O.Ps pray for dismissal of the case.

            Points for decision in this case is whether there is any deficiency in service on the part of the O.Ps or not.

                                                                        Decision with reasons

            At the very outset, it must be stated that on 4.4.2017 Khokan Sardar , complainant, filed an application that he has got already electric connection on 24.7.2016 which was obtained after filing the case. She he has nothing to say in the argument and he expressed his highly gratitude towards the Consumer Forum.

            In this circumstances, we are applying our considerable judicial mind and we find that connection was given after admission of the case and after notice was served. This is although one achievement of the Consumer/complainant, but at the same time a message to the O.P WBSEDCL that they are service provider of giving electricity which is the needs of the day of any human being as well as others to maintain their livelihood and if they so reluctant in each and every case the poor person comes to the Forum like this complainant for redressal of his grievances towards WBSEDCL for not getting electric supply and we must have to say at this juncture that they are not providing efficient services.  But when the summon as served they woke up and installed electric connection.

            This is the sorry state of affairs. So, Divisional Engineer, Baruipur RE ,Project Office is hereby informed to take all sorts of attempt to providing new  electric connection within a short span of time, as because  nowadays it cannot be the dream of any one (if they have capacity to pay energy charges) . It should be mentioned here that Article 21 of the Constitution of India has given the right to the citizen of India to have electricity and water facilities. So, the importance of the O.P is once again knocked down by the bench of Consumer Forum who are functioning in view of Section 13(5) of the C.P Act, which is a judicial proceedings. Hopefully the O.Ps will think over the matter and do the needful in near future and this order must be treated as a guideline and due to their fault the Government has to pay compensation , penalty etc. and it is also to be mentioned here that time will come when Government will deduct compensation and penalty from the salary of the faulty employees of WBSEDCL.

            With that observation,it is

that  case is disposed of since at this stage complainant has no grievance and no cost is imposed since complainant already received Rs.3500/- for non-filing written version by the O.Ps.

            Thus this case is disposed on full satisfaction of the complainant.

Let a plain copy of this order be served upon the complainant free of cost and one copy be sent to the O.Ps through speed post .
