Being aggrieved this complaint has been filed.
The loan account was closed in 2018 and reassignment of the policies made on 23.3.2022. For issuance of duplicate policy bond letter was issued on 18.3.2022 .Here a question arises what prevented the O.P.No.3 not to hand over the policy bond immediately after the closure of the loan account. The O.P.No.3 admitted the fact of misplacement of the original policy bond which is a nationalized Bank. The property/documents of the customers are not secured .It not only proves the negligence of O.P.No.3 at the same time is a deficiency in service on the part of O.P.No.1 to 3. The complainant was harassed observing the procedural formalities executing indemnity bonds, taking the help of advocates, spent money to obtain the duplicate. Original is always original and the duplicates are temporary arrangements. The O.P.No.1 to 3 cannot take the benefits harassing a customer in the name of the nationalized Bank. For the negligence and deficiency in service following order is passed:
ORDER.
The complaint is allowed on contest against the O.P.No.1 to 3 and dismissed against O.P.No.4. The O.P.No.1 to 3 are directed to pay Rs.1687.50 Ps + Rs.3500/- towards expenses for execution of indemnity bonds .Rs.50,000/- towards compensation and litigation expenses of Rs.5000/- within one month of this order to be paid to the complainant. In case of non payment the entire amount will carry 12% interest P.A till realisation.
