SHRI PURUSHOTTAM SAMANTARA, PRESIDENT:

1. In compact, the complainant being the Managing Director of LAMPS, Janghira Primary Agricultural Society, alleged to have sustained loss on the theft reported under FIR No.38/2011 Pandapada U/s.457/380 the complainant MD of LAMPS named Ugresena Behera.

2. The complainant averred ensured Insurance vide Policy No.163006/48/11/ 9800000089 (Misc-Non-Traditional Business) which covers dt.26.05.2011 to 25.05.2012. The sum Insured Rs.2,00,000/- and premium taken Rs.847/- as consideration.

3. It is said on 10.09.2011 at 5 pm the alleged theft occurred, intimated to the Police and Insurer. FIR received, the occurrence also widely reported in daily and also on Sambad dt.13.09.2011 stated the Insurer deputed Surveyor but not inclined to settle the claim till the date of Institution.

4. For which sustained mental agony and harassment, prayed direction be passed in pay the settlement amount and placed reliance on F.I.R Copy, Installation Certificate, Challan Copy, Letter to O/C and claim Form etc. in photo copies.

5. On notice dt.11.09.2015, the OP appeared on dt.25th Nov. 2016 and filed the version 15th Jan. 2017 in a too belated period.

The National Insurance Company (herein after known as) OPs made the version in admission of the policy issued, claim intimation lodged and deputation of surveyor and contested the case contending there is no cause of action, barred of limitation, implication of law of estoppels, mis -joinder & non-joinder of parties above all not maintainable and beyond the coverage of the policy, in the above circumstance the petition deserve to be dismissed with cost.

On perusal record reveals, the complainant intimated with deputation of surveyor and the petitioner handed F.I.R, Install certificate etc. to the surveyor but it is not in record neither surveyor deputed to assess the loss nor assessment reported submitted in consideration, which is mandatory provision U/s.64 UM Sub-clause (2) of the Insurance Act which reads –“No claim in respect of loss which has occurred in India and requiring to be paid on settled in India equal to or exceeding twenty thousand rupees in value on any policy of Insurance, arising or intimated to an Insurer at any time after the expiry of a period of one year from the commencement of the Insurance (Amendment) Act 1968 shall unless otherwise directed by the Authority, be admitted for payment on settled by the Insurer unless he has obtained a report, on the loss that has occurred, from a person who holds a license issued under this section to act as a surveyor or loss assessor……………………………………or loss assessor.

8. And non-settling the claim within statutory obligation of regulation in the present case, it is not in evidence that either surveyor deputed or report of assessment submitted. Non-observance of the provision on the part of the OPs amplify, commission of utter negligence under the provision of the 2 (g) that “Nature and manner of performance which is required to be maintained by or under any law for the time being in force” - has been not complied and mutilated in disobedience, which amounts deficiency service and the Insurer is liable to pay the loss, harassment and mental agony sustained due to such unfair & deceptive practice.

O  R  D  E  R

The case is allowed on contest. The OPs are hereby directed to pay the petitioner a sum of Rs.33,000/- (Rupees Thirty three thousand) only towards the loss sustained along with a Rs.2,000/- (Rupees Two thousand) only as compensation, harassment & mental agony inclusive of cost within four weeks of this order, failing @9% interest per annum will accrue on the entire amount till realization without any demur.

Copy of the Order be made available to the parties as per rule.

File be consigned to record room.
