This is a petition filed under Section 17-A of Consumer Protection Act, r/w Sec.151 of CPC by the Petitioner seeking transfer of the complaint bearing CC No.235/2015 pending on the file of District Consumer Disputes Redressal Forum, Rangareddy to any one of the District Consumer Fora at Hyderabad.
2. It is contended by the Petitioner in the affidavit in support of the petition that the District Forum, Rangareddy is located at a distance of 40 kilometers from his residence and that he being a senior citizen aged 69 years having underwent heart operation one year ago is experiencing severe strain on his health to travel a distance of 40 kilometers as also the doctor advised him not to take long travels. Hence, prayed for transfer of the pending complaint from the file of District Consumer Forum to any of the District Consumer Fora at Hyderabad.
3. Heard.
4. The contention of the Petitioner is that on account of undergoing heart surgery by him, he is feeling strained to travel the distance covering 40 kilometers from his residence. The relief sought for by the Petitioner is transfer the pending complaint from the file of District Consumer Forum, Rangareddy to any of the District Consumer Fora at Hyderabad. Admittedly, District Consumer Fora, Hyderabad where the complaint is sought to be transferred and the District Consumer Forum, Rangareddy are located within the limits of twin cities, within a distance of five kilometers from one another, as such, this Commission feels that it would not make much difference for the Petitioner in attending any of the Fora. Hence, the petition do not merit any consideration and devoid of any merits, accordingly, the transfer petition is dismissed but no costs.
