          This is a complaint filed by the Complainant  under Section 17 (1) (a) (i) of the Consumer Protection Act, 1986  praying to direct the Opposite parties to provide brand new AUDI Q3 35 TDI Quattro car bearing all the expenses such as road tax, insurance, spares and accessories charges apart from the invoice value of the car or in the alternative to refund the cost of the vehicle/AUDI Car, to the tune of Rs.48,00,000/- inclusive of spares and accessories, road tax, insurance, etc., together with interest @ 24% per annum from 06.07.2016 till realization; to compensate the complainant from 06.07.2016 onwards for a sum of Rs.75,500/- per month, being the EMIs paid by the Complainant by keeping the car bearing registration No. TS 08 EK0888 with the Respondents 3 and 4 till the date of realization; to pay compensation of Rs.15,00,000/- for causing agony, pain, hardship, inconvenience, trouble, etc., both mentally, monetarily and physically as a result of sheer negligence and deficiency of service on the part of the Opposite Parties and also for not using the vehicle from 06.07.2016 and costs of the complaint, in the circumstances of the case.

 

 

          No representation for the complainant.  Counsel for Opposite Parties 3 & 4 present.  Complainant filed settlement memo stating that the matter has been settled amicably by and between the parties and prayed that the complainant may be permitted to withdraw the complaint.  In the circumstances, permission is accorded and the complaint is dismissed as withdrawn.
