The case of the complainant in brief is that he deposited Rs.3,00,000/- to Elora International Ltd. as fixed deposit. The O.P nos. 1,2,3 & 4 are the authorized signatory and directors of the above company and O.P-5 is the authorized agent through whom complainant deposited the money. Unfortunately, the complainant lost the receipts and filed a missing diary to local P.S and accordingly he communicated the same to the O.Ps to re-issue duplicate certificates and money receipt regarding the deposited amount, but the O.Ps kept silent regarding the matter. After the maturity of the amount in due time he went to the O.P to get the matured amount but the staff of the O.Ps informed that for the time being payment has been stopped and accordingly he contacted the O.Ps and O.Ps assured him that he will get the cheque in time but till date he did not receive the cheque. Hence, this case.
The O.Ps did n’t shy to contest the case.
Complainant files documents.
Decision with reasons
The complainant only filed one G.D.E but he did not know and also submitted the maturity amount , date of maturity and also the bond number regarding the amount of Rs.3,00,000/- that he deposited to the O.Ps.
Under this circumstances we are also in a dark about the genuinity of the case. As he does not know the date of maturity, maturity amount and also the bond number, how he claimed the amount to the O.Ps.
As a result the case fails.
