The case of the complainants in short is that being allured and convinced by the authorized agent of the O.P-5 regarding higher rate of interest and benefits in the Fixed Deposit/Monthly Bond/other schemes, the complainants deposited their hard earn money to various monthly Bond Certificate Schemes with an expectation to earn money by way of getting benefit of higher rate of interest . The certificates were matured in due time and after maturity when the complainants contacted the O.P who on different pretext delayed to make payment and ultimately did not pay any single farthing to any of the complainants . Several requests yielded no result and hence the case.
Inspite of good service of notice, the O.P fought shy of contesting the case and accordingly the case proceeded exparte .
Points for decision in this case is whether there is any deficiency in service on the part of the O.P and /or unfair trade practice adopted by the O.P or not.
Decision with reasons
Perused all the documents and we find that O.Ps are intentionally avoiding the fixed deposit matured amounts for unlawful gain ,which is nothing but an unfair trade practice as well as deficiency in service.
Hence,
Ordered
That the application under section 12 of the C.P Act is allowed exparte.
The O.Ps are hereby directed to refund entire matured amount of Rs.12,92,880/- together with interest @10% p.a from the date of claim till its realization within 45 days from the date of this order.
The O.Ps are further directed to pay compensation of Rs. 5 lacs to the complainants for their strong mental agony and harassment and pay litigation cost of Rs.2000/- to each of the complainant i.e. 24 x 2 = 48,000/- within that stipulated period, failing which the complainants are at liberty to execute the order through this Forum and further interest will carry @ 9% p.a on the entire awarded amounts.
Let a plain copy of this order be given to the complainants free of cost and send a copy of this order to the O.Ps through post for their strict compliance.
