1. This is an application U/s 35 of the C.P.Act, 2019.
2. The complainant’s case in brief is that, he had purchased bond from the OP.2 (Sahara India) of different denominations for which the total amount of money invested by the complainant was Rs.2,11,300/-. The bond was for a period of six years. After the maturity of the bonds, the complainant requested the OP.2 to give him the matured amount but the OP.2 did not comply with the legitimate demand of the complainant. Hence this complaint.
3. On the other hand, the OPs did not appear in the case and were set exparte.
4 Perused the materials on record. The complainant had submitted before the Commission the photocopy of the bonds of different denominations and the total amount of money invested in such bonds comes around Rs.2,11,300/-. On perusal of the bonds, we find that, there is no such mention of maturity date of such bonds. The fact is that the OPs had issued the bonds to the complainant on receiving money. Hence the OPs are bound to return the amount invested by the complainant with them in terms of bonds. As there is no mention of date of maturity of such bonds, that does not debar the complainant from claiming the amount that he had invested in bonds issued by the OPs. Therefore, the complaint bears merit. Hence it is ordered.
ORDER
The complaint is allowed exparte against the OPs. The OPs are jointly & severally liable to pay the bond amount i.e. Rs.2,11,300/- (Rupees two lakhs eleven thousands three hundred) only to the complainant along with interest @ 9% per annum from the date of filing of the complaint till the date of payment. The OPs are further directed to pay a sum of Rs.10,000/- (Rupees ten thousand) only towards mental agony suffered by the complainant and a further sum of Rs.2000/- (Rupees two thousand) only towards litigation expenses. The order be complied with by the OPs, within a period of thirty days from the date of communication of this order, failing which the complainant will be at liberty to execute the order against the OPs in accordance with law.
The order is pronounced on this day the 27th September, 2022 under the seal & signature of the President and Member of the Commission.
