1. This is an application U/s 35 of the C.P.Act, 2019.
2. The complainant’s case in brief is that, he had deposited a sum of Rs.27,000/- on 28/07/2018, Rs.14,000/- on 31/07/2018 & a sum of Rs.12,000/- on 31/07/2018 in Sahara Credit Co-operative Society Ltd., at Buguda branch, Bhanjanagar (O.P.4). The OP.4 had issued certificates for each deposit. Those deposits were to mature on 28/07/2019 & 31/07/2019, respectively. On maturity of those amounts, the complainant had to receive Rs.29,430/-, Rs.15,260/- & Rs.13,080/- from the OP.4. But on maturity, the complainant did not receive that amount from the OP.4. Hence he files this complaint against the OP.4 along with the senior functionaries of Sahara Credit Co-operative Society Ltd.
3. On the other hand, the OPs were set exparte and exparte hearing was taken up on 11/01/2023.
4. Perused the materials on record. The complainant has filed the photocopy of the certificates showing the investment by him in Sahara Credit Co-operative Society Ltd. His evidence affidavit discloses that, he had to receive Rs.29,430/-, Rs.15,260/- & Rs.13,080/- on maturity of these certificates from the OP.4, with whom such deposits were made. Then it was the duty of the OP.4 to give the matured amount to the complainant but the OP.4 did not do it. Hence the complainant has the grievance to put up before this Commission and accordingly it is ordered.
ORDER
The complaint is hereby allowed exparte against the OPs. The OPs are jointly & severally liable to pay the matured amount, such as, Rs.29,430/-, Rs.15,260/- & Rs.13,080/- to the complainant along with interest @ 6% per annum from the date of application till the date of payment. In addition to that, the OPs are further jointly & severally liable to pay an amount of Rs.5,000/- (Rupees five thousand) only to the complainant towards compensation for mental agony suffered by him and a further sum of Rs.1000/- (Rupees one thousand) only towards litigation expenses. The order be complied with by the OPs within a period of one month from the date of communication of this order, failing which the complainant will be at liberty to execute the order against the OPs in accordance with law.
The order is pronounced on this day the 17th January, 2023 under the seal & signature of the President and Member (W) of the Commission.
