Order No.22 dt.06.05.2015:
The Complainant has filed this case praying for a direction to O.Ps to supply documents after conversion of the land in OLR Case No.457D of 2003 pending before O.P.No.2 and also for payment of compensation of Rs.7,000/- to him. In the instance case the Complainant had applied in the Court of Additional Tahasildar, Chandbali for conversion of agricultural land to homestead land at Dhamnagar Office which was registered in his Office vide OLR Case No.457/D/2003 and deposited premium of Rs.8,125/- in the R.I. Office, Panchutikiri against the said OLR Case. The said amount was collected by the then R.I. Sri Dasaratha Das without any order from the Addl.Tahasildar, Chandabali Headquarters at Dhamara. The said OLR Case on which the premium said to have been realized was not available. On the request of the Complainant the Tahasildar, Chandbali agreed to adjust the deposited amount for conversion of agricultural land of the Complainant to homestead land. The Complainant thereafter on 08.07.2013 filed a petition before the Tahasildar, Chandbali to adjust the said premium amount of Rs.8,125/- by converting the land under Khata No.173/120, Plot No.448 measuring A0.35 dec. and Plot No.449 measuring A1.26 dec. from agricultural to homestead in the prescribed Form. The Complainant has also filed application to cancel the OLR Case 457/D of 2003. Considering the petition of the Complainant, a new case bearing No.10 of 2014 u/s(A) of OLR Act has been instituted and the same is pending for disposal in the Court of Tahasildar, Chandbali.
This being the state of affairs and when the process is going on for conversion of land as applied by the Complainant and the said fact has been suppressed by the Complainant before this Forum, we do not find any deficiency in service on the part of O.Ps. The O.P.No.2 is directed to dispose of the case early as possible. Accordingly, the case is disposed of being pre-matured. Parties bear their own costs.
