            Sadananda Padhan, age about 40(forty) years, son of Late Dhanamali Padhan, Occupation-Cultivation, resident of village Baramkela, Po. Baramkela, under Ps/Tahasil. Barpali, Dist. Bargarh.                   .....                   .....                   .....               Complainant.

1. Shymala Agency, Authorised Dealer of Sonalika Rotavator, represented through its Proprietor, At/Po. Padhanpali Road, Bargarh, near flying over bridge, FCI Godown, under Ps/Tahasil/Dist. Bargarh.
2. Branch Manager, ICICI Bank, Bargarh, At/Po. Bargarh, under Ps/Dist. Bargarh.

            Case posted today for appearance and version by OP No.2(two) and version by OP No.1(one).

            In the meantime the advocate for the OP No.1 filed a Declaration said to have been made by the Complainant wherein the advocate concern submitted before the Forum, the disputed Rotavator has already been supplied with the Complainant against which the said declaration has been made by the Complainant.

            On the other hand, the advocate for the Complainant present before the Forum and submitted that it is beyond his knowledge that if such Declaration has ever been made. As such the same should not be taken into consideration and pressed for the version of the OPs.

            In view of the above fact and circumstances, we hereby direct the Complainant to be present personally before the Forum to examine the concern Declaration if made by him.

            At the same time the advocate for the OP filed a petition for adjournment to file his version.

            Time allowed.

            Put up on Dt. 11/11/2019 for personal appearance of the Complainant and filing of version by the OP No.1(one) and appearance and version by Op No.2.

Later on,

            The Complainant being present personally before the Forum, submitted a petition along with affidavit on the ground that the Rotavator involve in the case is already received by him from the OP No.1 as such he does not like to proceed for in the case against the Opposite Parties. In support of which has filed an Affidavit praying therein to withdraw the case against the OPs.

            Hence, in view of such circumstances the case is dropped and accordingly the case is disposed off today in the open court.
