Dist. Bar Association, Bargarh vide their letter No.DBA 434/21 Dt.16/03/2021 have informed that, at present the pandemic situation of Conona Viruse is very much hauling and it is increasing day by day and every body is taking precautions to save from corna attack and for the same an emergency meeting of the Dist. Bas Association, Bargarh held and a unanimously resolution has been taken to participate in hearing mater if both parties are having consent for the same. That apart the urgent matter, bail matter along with injuction cases may be takne up as before till 1st May 2021. At the same time they are glad to request for not to pass any adverse order in case of no step is taken by any party in any case and they seek to like co-operation from the concerned courts in such matters.
However, Sri P.K.Acharya, Advocate for the Opposite Party/JDR present before the Commission with the Opposite Party/JDR No.1(one) i.e. S.D.O (Electrical), WESCO, Bargarh, Po/Dist. Bargarh and wanted to receive the statutory amount which was deposited by him in this Commission amounting to Rs.3,500/-(Rupees three thousand five hundred)only as per order Dt. 03/11/2020 of the Hon'ble State CDR Commission, Odisha, Cuttack in F.A. No. 312 of 2019.
The Opposite Party/JDR No.1(one) present and requested to issue the cheque in the name of the T.P.W.O.D.Ltd, BED, Bargarh because presnetly the T.P.W.O.D.Ltd has taken over the charge from the WESCO in place of E.E. Electrical, Bargarh.
As per Order Dt. 03/02/2021 of this Commission, the Statutory amount deposited in Term Deposit of Rs.3,500/-(Rupees three thousand five hundred)only has been encashed and along with interest of Rs.3,658/-(Rupees three thousand six hundred fifty eight)only has been deposited in the Saving Bank Account of President, Dist. CDR Commission, Bargarh.
A cheque bearing No. 390035 Dt.18/03/2021 amounting of Rs. Rs.3,658/-(Rupees three thousand six hundred fifty eight)only of President, Dist. CDR Commission, Bargarh has been issued in the name of T.P.W.O.D.Ltd, BED, Bargarh as per request of the Opposite Party/JDR No.1(one) and handed over to the Opposite Party/JDR No.1(one) at present of the his Advocate Sri P.K.Acharya to comply the Order Dt. 03/11/2020 of the Hon'ble State CDR Commission, Odisha, Cuttack in F.A. No. 312 of 2019.
As per order Dt. 03/11/2020 of the Hon'ble State CDR Commission, Odisha, Cuttack in F.A. No. 312 of 2019, the First Appeal bearing No. 312 of 2019 arising out of C C No. 72 of 2018 is allowed with no cost and the petition on Dt. 03/02/2021 filed by the Opposite Parties/JDRs considering the same and dropped the proceeding.
Hence, gone through the petition filed by the Opposite Parties/JDRs and considering the same the statutory amount is refunded to the Opposite Parties/JDRs and in accordance with the Order Dt. 03/11/2020 of the Hon'ble State CDR Commission, Odisha, Cuttack in F.A. No. 312 of 2019, the present Execution proceeding against the Opposite Parties/JDRs is dropped and the case is disposed off accordingly.
