1. This is an application U/s 35 of the C.P.Act, 2019.
2. The complainant’s case in brief is that, he had enrolled himself in Bharat Matrimony for assisted service regarding search of a suitable & matching bride for his son. He paid Rs.14,000/- to the Bharat Matrimony for such purpose. The OPs 1, 2 & 3 are Manager, Deputy Manager, Assisted Services, Relationship Manager, Assisted Services, respectively. As alleged by the complainant, although the Bharat Matrimony took money for providing assisted service, but in reality they did not provide any such service. As there is deficiency in service, the complainant filed this complaint against the OPs.
3. On the other hand, the OPs filed written version stating therein that they had provided adequate service to the complainant. The complainant had shared 73 profiles through Bharat Matrimony. It is also submitted that the Bharat Matrimony arranged nine meetings between bride and bride-groom. In short, it is submitted by the OPs that as this is a vexatious complaint, it is liable to be dismissed with cost.
4 Perused the materials on record. The assisted service means one person on behalf of Bharat Matrimony, should act as a mediator or negotiate between the parties and arrange their conversation through Video calling. But as it appears, the OPs have not provided service of such nature to the complainant. The mere fact that the complainant had shared 73 profiles through Bharat Matrimony, does not establish that the OPs had provided assisted service to the complainant. The claim that the OPs had arranged nine meetings between bride and bridegroom, does not inspire confidence in us. As there is deficiency in service on the part of the OPs, the complaint bears merit. Hence it is ordered.
ORDER
The complaint is allowed on contest against the OPs. The OPs are hereby directed to refund Rs.14,000/- (Rupees fourteen thousand) only to the complainant. The OPs are further directed to pay a sum of Rs.5,000/- (Rupees five thousand) only towards compensation for mental agony suffered by the complainant and a further sum of Rs.1000/- (Rupees one thousand) only towards litigation expenses to the complainant . The order be complied with by the OPs within a period of one month from the date of communication of this order, failing which the complainant will be at liberty to execute the order against the OPs in accordance with law.
The order is pronounced on this day the 19th August, 2022 under the seal & signature of the President and Member of the Commission.
