JUDGEMENT
The present complainant’s Ld. Lawyer has appeared at the time of admission hearing.Heard Ld. Lawyer and considered the entire complaint and particularly relied as prayed for by the complainant.
Ld. Lawyer for the complainant submitted that the complainant is a consumer but after studying the entire complaint it is found that Vibgyor Allied Infrastructure Ltd. , is a company incorporated under the Companies Act, 1956 and it is his business for commercial purpose and practically complainant undertook a big project to build Film city, resort, Bungalow in the name of DOLLYWOOD and to achieve the same duly purchased big plot of land at a scenic beauty place in the in the district of Jalpaiguri, West Bengal and started construction work for commercial purpose and for which it is apparently proved that complainant is not a consumer whose entire purpose is business or getting any service from other Companies for construction of the Film City is always and shall be treated as commercial purpose and for the reason stated above the present complainant is not maintainable as the complainant is not a consumer as per C.P. Act, 1986 and, as such, the complaint is rejected as the same is being not admitted for further proceeding.
